TWE Community and Student Terms and Conditions

    Welcome to the TWE Community!  This website and community is owned and operated by The Willing Equine LLC. By visiting this website, registering as a Member and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’), along with the terms and conditions as stated in our Liability Release (please refer to the Liability Release section below for more information).

 

This agreement is in effect as of August 19, 2020. 

 

   We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications, will constitute acknowledgment and agreement of the modified terms and conditions.

Responsible Use and Conduct 

 

   By visiting our website, creating an account on the community site, signing in as a Member and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as ‘Resources’), you agree to the following:

 

a. All resources are subject to the interpretation of the client. How you use the information within TWE Community and provided during services, is entirely up to you. In utilizing any of the methods, practices, etc. for horsemanship suggested by The Willing Equine LLC or any TWE associate, there is no guarantee of success or safety for human or horse.

b. All resources of the The Willing Equine Community (community.thewillingequine.com), and The Willing Equine website (thewillingequine.com) are the property of The Willing Equine LLC. All lessons created by Adele Shaw of The Willing Equine or TWE associates are for education, information, and entertainment purposes only.

​

c. Resources from any of the TWE courses and groups are to be used only by you, the enrolled member.  Any sharing of materials to sources and individuals outside of the TWE Community (community.thewillingequine.com) must be approved by Adele Shaw or a TWE associate.

d. Any instruction given as to the health care and nutrition of equines is intended as a supplement to, NOT a replacement of, advice from licensed veterinary professionals. Please consult your veterinarian regarding any health concerns.

e. We use Mighty Networks (a US-based company) for the The Willing Equine Community. On joining the community you are agreeing to Mighty Network Terms and Conditions and Privacy Policy.

​

f. In order to access certain Resources, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date. 

​

g. You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account/s. 

​

h. Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means. 

​

i. You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability

​

j. We provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:

i. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;

ii. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;

iii. Contains any type of unauthorized or unsolicited advertising;

iv. Impersonates any person or entity, including any The Willing Equine LLC employees or representatives.

We have the right at our sole discretion to remove any content that we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

k. We do not assume any liability for any content posted by you or any other 3rd party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of https://community.thewillingequine.com/, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute according to the Terms of Confidentiality. This only refers and applies to content posted via open communication tools as described and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our privacy policy.

l. You agree to indemnify and hold harmless https://community.thewillingequine.com/ and its parent company The Willing Equine LLC and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to assume the exclusive defence and control of any claim for which we are entitled to indemnification under this User Agreement. In such an event, you shall provide us with such cooperation as is reasonably requested by us.

m. Your access to Resources varies depending on the Payment Plan you purchased. In case of termination or cancelation of your Payment Plan for any reason, and on expiry of that plan, access to the Resources included in that subscription will be lost. 

​

n. Any member under the age of 18 must agree to have a legal guardian read and agree to the conditions stated in this agreement, create the member's account, and supervise any activities on the community. The Willing Equine LLC does not assume any liability for the activities performed by a minor. 

​

n. You agree to the The WIlling Equine Online Learning Community Member Guidelines stated below:

Be supportive. Encourage and support your fellow members. No one here is looking for criticism, cynicism, or judgement. (We can get those things on the rest of the Internet ;) We may however be looking for advice from our fellow horse people! If you want advice, please clarify that in your post as "Advice welcome". And if you'd like to give advice but the original poster didn't explicitly ask for it, consider asking if they would mind some suggestions before offering advice. 

​

Share generously. Your stories and experiences may be exactly what another member needs to hear today to solve a problem or seize an opportunity.

​

Respect Privacy. Being part of this group requires mutual trust. Authentic, expressive discussions make groups great, but may also be sensitive and private. What's shared in the group should stay in the group. 

​

Be constructive. We’re here to push each other forward and lift each other up. Find ways to help each other think bigger, re-frame challenges, and stay curious. We are all on a living, breathing, and ever evolving horsemanship journey that greatly benefits from discussing and group support!

​

Don’t spam, promote, or troll. This community exists to help you learn. It’s not a place to spam, promote your services, or bully anyone else. 

​

Sharing Outside Content In A Negative Light. This is strongly discouraged as it creates an environment of judging. Let's stay focused on our own training, goals, and caring for our horses in a positive way.

​

Non TWE Training Practices. This group is centered around TWE best practices and training approaches. We encourage the sharing of training ideas, different approaches, and creative thinking, but discourage specifically advertising the training practices of trainers outside of the TWE community. If you're not sure if you should or shouldn't mention something in the group, feel free to message us and ask! There's absolutely no harm in asking. :)

 

Do Not Share Copyrighted Material. Please do not copy, quote, print out, or share any of the TWE copyrighted material (such as the PDF files and videos) outside of this group, and all discussions within this group should stay within this group unless you have specific permission from the creator of the content.

Hopefully, these should be easy agreements. If you think you’ll be unable to abide by these guidelines, let us know and we’re happy to remove you. If you break these guidelines you'll receive one warning before being removed.

By CREATING AN ACCOUNT AND SIGNING IN TO THE COMMUNITY YOU ARE AGREEING TO THE FOLLOWING:

I, __________________, HEREBY ACKNOWLEDGE that I have voluntarily applied to participate in instruction with THE WILLING EQUINE, LLC.

​

I AM AWARE THAT ACTIVITIES INVOLVING HORSES CAN BE INHERENTLY DANGEROUS AND HAZARDOUS, AND I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH.

 

IN CONSIDERATION for being permitted to participate in said instruction:

1. I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, Adele Shaw, individually and doing business as The Willing Equine, LLC., each and every agent, employee or rider thereof, and the Sponsor or Sponsors named above, all for the purposes herein referred to as “Releasees”, from all liability to myself, my legal representative, distributes, guardians, assigns, heirs, and next of kin, all for purposes herein referred to as “Releasors”, for injury, death, or damage resulting from my participation in said instruction and training as a result of the negligence of Releasees, or any employee, servant, agent, or contractor of Releasees. I FURTHER RELEASE AND DISCHARGE Releasees from all liability to Releasors for injury, death or damage resulting from my participation in said instruction and training as a result of the negligence of any other party or parties in attendance. In addition, I HEREBY RELEASE AND DISCHARGE Releasees from all actions, claims or demands Releasors now have or may hereafter have for injury, death, or damage resulting from my participation in such activities.
 

2. I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS Releasees and each of them, from any loss, liability, damage, or cost they, or any of them, may incur due to my participation in said instruction and training.
 

3. I HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of Releasees, or any of them, or of any employee, servant, agent, or contractor of Releasees resulting from my participation in said instruction or training.
 

4. I EXPRESSLY acknowledge that activities involving horses involve INHERENT RISKS which mean that there are dangers or conditions which are an integral part of horse activities and include, among other things, the propensity of a horse to behave in ways that may result in injury, harm or death to persons on or about them; and the unpredictability of a horse’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons, or other animals.
 

5. I AM OVER THE AGE OF 18 and/or my legal guardian is supervising my enrollment in the TWE Community, is supervising equine related activities, and has read, understands, is agreeing to this disclaimer and waiver of liability as well as the terms of use stated above. 

 

I HAVE CAREFULLY READ THIS DISCLAIMER AND WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE WILLING EQUINE, LLC. AND I SIGN IT, by becoming a member of the The Willing Equine Community, OF MY OWN FREE WILL and further agree that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
